Terms of Service

1. Agreement to Terms

By accessing or using Feedback Guardian ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Feedback Guardian is a customer feedback collection and analytics platform that enables businesses to deploy feedback forms at physical and digital locations, collect customer sentiment ratings and comments, analyze response data through dashboards and reports, set up automated alerts based on feedback thresholds, manage teams and collaborate on feedback data, and generate QR codes and print-ready materials for feedback collection.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access to your account. You must be at least 18 years of age to create an account and use the Service.

4. Free Trial

Feedback Guardian offers a -day free trial for new accounts. No credit card is required during the trial period. At the end of the trial, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your account may be deactivated, although your data will be retained for a reasonable period to allow you to reactivate.

5. Subscription Plans and Billing

Paid subscriptions are billed monthly in advance via Stripe. Plan pricing, features, and limits are described on our pricing page and may be updated from time to time with reasonable notice. You may upgrade, downgrade, or cancel your subscription at any time through the billing settings in your dashboard. Downgrades or cancellations take effect at the end of the current billing period. Refunds are available on a case-by-case basis within the first 14 days of a paid subscription. All fees are stated in US dollars and are exclusive of applicable taxes.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Collect feedback data from minors (persons under 18) without verifiable parental consent
  • Submit or solicit feedback that contains personal health information, financial account numbers, or other highly sensitive personal data through the feedback forms
  • Attempt to probe, scan, or test the vulnerability of the Service or circumvent any security mechanisms
  • Use the Service to send spam, phishing, or other unsolicited communications
  • Interfere with the Service's infrastructure or impose an unreasonable load on our systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute the Service without written consent

7. Data Ownership and Licenses

Your Data. You retain all ownership rights to the feedback data, comments, and other content collected through the Service ("Customer Data"). You grant Feedback Guardian a limited, non-exclusive license to process, store, and display Customer Data solely for the purpose of providing the Service to you.

Our Service. Feedback Guardian and its licensors retain all rights, title, and interest in the Service, including all software, designs, trademarks, and documentation. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

8. Data Processing and Security

We take reasonable administrative, technical, and physical measures to protect Customer Data. Our data processing practices are described in our Privacy Policy. Customer Data is stored on secure infrastructure provided by Supabase and processed within the United States. We will notify you of any data breach affecting your Customer Data within 72 hours of becoming aware of the breach.

9. Team Accounts and Access

Account administrators may invite team members with four role levels: Admin, Viewer, Location Manager, and Location Viewer. Location-scoped roles restrict access to specific assigned locations. You are responsible for the actions of all team members you invite. We recommend using the principle of least privilege when assigning roles — grant only the minimum permissions necessary for each team member's function.

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance through in-app announcements. We are not liable for any loss or damage resulting from Service downtime, whether planned or unplanned.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Feedback Guardian and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service. Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to Feedback Guardian in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.

13. Termination

You may terminate your account at any time by canceling your subscription and contacting us. We may suspend or terminate your account if you violate these Terms, fail to pay applicable fees after reasonable notice, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. We will make your Customer Data available for export for 30 days following termination, after which it may be permanently deleted.

14. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by email or through an in-app announcement at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
